Terms of Service

Template for review. These Terms are a starting draft and must be reviewed and completed by a qualified lawyer before Pixtedy charges real customers. Bracketed items (e.g. [Operator]) must be filled in once the operating entity is registered.

1. Who we are & acceptance

Pixtedy ("Pixtedy," "we," "us") is an AI video translation and dubbing service operated by [Operator legal name / Osek registration number, Israel] ("Operator"). By creating an account, uploading content, or using the service (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You may not use the Service if you are barred from doing so under any applicable sanctions or export-control laws.

3. The Service & beta status

Pixtedy lets you upload a video and receive an AI-generated, translated and lip-synced version. The Service is provided "as is" and is in beta: it may change, break, lose data, or be discontinued at any time. Output is produced by automated AI systems and may contain errors, mistranslations, or artifacts; you are responsible for reviewing output before relying on or publishing it.

4. Accounts

You are responsible for your account, your credentials, and all activity under your account. Provide accurate information and keep it current. Tell us promptly of any unauthorized use.

5. Plans, credits, billing & taxes

Paid plans, credit balances, and per-job pricing are shown in the app before you are charged. A free quote is always shown before any paid job runs.
Payments are processed by our third-party payment provider. Depending on the provider, the provider may act as the merchant of record and may collect and remit applicable VAT, GST, or sales tax based on your location.
Prices are exclusive of taxes unless stated. Where tax is not handled by the payment provider, you are responsible for any taxes due in your jurisdiction.
Subscriptions renew automatically until cancelled. You can cancel anytime; cancellation stops future renewals.

6. Refunds

Because dubbing jobs consume real third-party processing costs, completed jobs are generally non-refundable. If a job fails, the amount charged for that job is automatically credited back to your balance. EU/UK consumers: by starting a paid job you request immediate performance of a digital service and acknowledge you thereby lose the statutory 14-day right of withdrawal for that job. Unused balances and subscription disputes are handled at contact@pixtedy.com.

7. Your content and the rights you must have

By uploading a video ("Your Content") you represent and warrant that:

You own Your Content or have all necessary rights, licenses, and permissions to upload and process it;
You have the explicit consent of every person whose face or voice appears in Your Content to create an AI-translated/lip-synced version of them;
Your Content and your use of the output do not infringe any copyright, trademark, privacy, publicity, or other right, and do not violate any law.

You grant us a limited licence to host, process, and transmit Your Content and the output solely to provide the Service (including sending it to the sub-processors listed in Section 9). We claim no ownership of Your Content or the output. You must honor any request from a depicted person to remove content depicting them.

8. AI-generated output & disclosure obligations

Output is synthetic media created by AI (a "deepfake" in the legal sense). Laws in some jurisdictions — including the EU AI Act (transparency obligations apply from 2 August 2026) — require that AI-generated or manipulated audio/video be clearly disclosed and labeled. You are responsible for disclosing and labeling output as AI-generated wherever you publish or distribute it, as required by the laws that apply to you. We may apply or embed an AI-content marker or watermark on output.

9. Third-party services / sub-processors

To provide the Service we send content and/or data to third-party providers. Your use of the Service is also subject to their terms and acceptable-use policies, including their content and consent requirements:

HeyGen — AI translation & lip-sync of your video (terms). HeyGen requires that you have the rights and explicit consent for any likeness you process and prohibits deceptive, infringing, hateful, sexual, political-campaign, and other restricted content.
Google (Gemini) — language/translation assistance.
Supabase — authentication, database, and encrypted file storage.
Google Cloud / Firebase — application hosting.
Our payment provider — billing and, where applicable, tax handling.

10. Acceptable use

You agree not to use the Service to create, upload, or distribute content that:

depicts a real person without their rights/consent, or impersonates, defames, or harasses anyone;
is sexual, especially involving minors; is hateful, violent, or harassing; promotes scams, fraud, or misinformation; or interferes with elections or political campaigns;
infringes intellectual-property or privacy rights, or violates any law, sanctions, or export controls.

We may remove content and suspend or terminate accounts that violate this section.

11. Intellectual property

The Service, software, and Pixtedy brand are owned by the Operator and its licensors. These Terms grant you no rights in them except to use the Service as permitted.

12. Disclaimers

The Service and all output are provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We do not warrant that output is accurate, fit for any purpose, lawful in your jurisdiction, or error-free.

13. Limitation of liability

To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid us for the Service in the three months before the claim.

14. Indemnification

You will indemnify and hold harmless the Operator from any claim arising out of Your Content, your use of the output, or your breach of these Terms — including claims that you lacked rights or consent for a person depicted in Your Content.

15. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. Sections that by their nature should survive (e.g. 7, 12–14) survive termination.

16. Governing law

These Terms are governed by the laws of the State of Israel, and the competent courts of [district, Israel] have exclusive jurisdiction, without affecting mandatory consumer-protection rights you may have where you live.

17. Changes

We may update these Terms. Material changes will be notified in the app or by email; continued use after changes take effect means you accept them.
